Pursuant to Local Government Code § 234.140, Tarrant County adopted their Tarrant County Game Room Regulations on Nov. 12, 2019. Under the statute and the regulations, a game room is a place that contains six or more statutorily-defined gaming machines. The new regulations have provisions, in part, that:
- restrict the location of game rooms by imposing distance requirements of 1,500 feet from existing or planned schools, places of worship and residential neighborhoods;
- restricts the location of game room within 2,000 feet from another game room;
- impose licensing requirements;
- require inspections; and
- provide for civil and criminal penalties.
Importantly, under certain circumstances, game rooms in “good standing” may be exempt from the regulations’ distance requirements, but only if an application claiming a distance exemption is received by the Development Services Department by April 15, 2020.
The Tarrant County Game Room regulations become effective on April 1, 2020 and affect game rooms in the City of Fort Worth that are located in Tarrant County. The regulations and the city’s Interlocal Agreement with Tarrant County are available below. These documents should be carefully reviewed. If you believe that you qualify for an exemption to the regulations’ distance requirements, an application is also available below.
Game rooms must also pay any applicable city game room occupation tax.
