Encroachment Information and Forms
Encroachment is when any physical object projects into the City's right-of-way and/or City-owned easements. The physical object can include any portion of a building, including an awning or a fence for example. It can also include signs and conduits. For additional information, please contact Cassandra Foreman at 817-392-8188. Please find the fees below as approved on 7/25/2006 - Ordinance No. 17071-07-2006 & 17072-07-2006.
The Development Director may authorize all encroachments into public Right-of-Way or City-owned easements, with the exception of encroachment requests that fall under the category of "Major Encroachments". Major encroachments are defined as building structures on, above or below public Right-of-Way. Major encroachment requests must go to the City Council for approval.
Effective Nov. 5, 2012: All right-of-way and encroachment agreements processed will be subject to an annual charge equivalent to $0.56 per square/linear footage of the encroaching item. The fee initially will be collected at the point of application and then annually for the duration of the terms of the agreement (30 years unless otherwise agreed upon).
