Noncompliance FAQs

Why the change in fees?

The primary goal is not to generate revenue, but to reduce improper solid waste disposal. Overloaded carts and loose bags create operational challenges and can cost the City thousands of dollars. Correct disposal helps create and maintain a clean, safe city.

When do the fees go into effect?

These fees are effective as of January 1, 2024 per City Council approval of amendment to City ordinance Chapter 12.5, Environmental Protection and Compliance, Article VIII, Solid Waste and Recycling, Division 4, Deposits, Rates and Collection, Section 12.5-841.1, Residential Collection Fees.

What does this mean for residents?

This fee increase will only affect residents whose garbage and recycling carts are noncompliant.

What is an Overloaded Cart?

By City ordinance, all carts shall be placed at the curb with the lid properly and securely closed. Any cart lid that is not fully closed due to excess garbage or recycling materials can be considered an overloaded/overfilled cart. The penalty fee is $6.00 per overloaded cart.

If the wind blows a lid open, would that be charged?

No, so long as the cart is not overloaded there will be no charge to the resident.

What is a “loose bag”?

A loose bag is any bag of garbage or recycling material that is placed outside of/next to the City provided garbage or recycling cart. The penalty fee is $3.00 per loose bag.

Are yard waste bags considered “loose bags”?

No, brown kraft paper yard bags are not considered loose bags. Yard bags are accepted as part of the weekly yard waste program and are not subject to any additional charges, but must be properly placed and separated at least two feet from garbage and recycling carts.

How does the City determine if my carts are noncompliant?

When carts are properly set out, it allows for Smart Truck Technology use. Smart Truck vehicles used in Fort Worth are equipped with Automated Side Load (ASL) collection access, vehicle cameras and image recognition software. While in route, collection vehicles capture data to monitor collections, resolve resident issues, verify noncompliant disputes and improve service levels.

How are fees assessed?

These new fees will be assessed on the City utility/water bill as Solid Waste fees.

Can these fees be appealed?

Yes, any resident wanting to appeal a Solid Waste fee can contact the Call Center at 817-392-1234 and ask to file an appeal.

Can I upgrade my garbage cart size?

Yes, residents are allowed to upgrade and exchange their garbage carts to another size once a year at no charge. Residents can also request multiple carts to accommodate their household disposal needs. New cart size fees and/or multiple cart fees will be reflected on the City utility/water bill as Solid Waste fees.

Are there alternative ways to dispose of excess garbage and recycling?

Yes, residents can visit any City Drop-Off Station to dispose of excess garbage and recycling items. Hazardous household waste, yard waste and bulk waste items are also accepted. This service is free of charge to residents. Proof of residency is required and there may be quantity limits for certain items. View Drop-Off Station webpage for more information.

Is there a time extra bags can be put out without being charged?

Yes, all residents are allowed two extra bags of garbage next to the cart on their first pickup day following each of the following holidays: Thanksgiving Day, Christmas Day, and New Year’s Day.
